Cultural history of marijuana 

One of the most controversial and talked about topics over the course of recent human history has been marijuana and its consumption. It has been the topic of debate for a number of years now as it was always considered a drug that could be potentially dangerous to a person’s health, much like any chemical drug might do. 

All of this controversy led to the recreational use of marijuana being banned practically worldwide, and the medicinal use only available to those who were absolutely desperate for it. Today, many states in America have legalised both just the medicinal use and even the recreational use as well, making the market grow insanely and be massively successful. This has led to exciting new inventions for those with an interest in the marijuana culture, like vaporizers, electric grinders, or even electric dab rigs. While people may know these basic facts, they might not know the actual cultural history that comes surrounding marijuana, so if you want to learn more, here is some information about the cultural history of marijuana. 

Ancient times

Marijuana, also known as weed, cannabis, or pot, has an incredibly long history that could consider it to be an ancient drug. Most countries and cultures didn’t intend to grow the plant and make use of it in order to feel a high, but rather for medicinal purposes. It is said that it was most likely to have been discovered somewhere in Asia all the way around 500 BC. 

Earlier hemp plants are known to be native to Asia and are slightly different to the cannabis plants that we make use of today that have been specially grown with different strains to feel different and more intense highs. Typically, beyond its medicinal use, hemp fibre was used to make paper, clothes, and ropes and even provide food from the seeds. 

It has also been seen to have been used ceremonially with the graves of shamans in both Siberia and china having burned cannabis seeds in them, dating all the way back to 500BC

The 19th century

Moving forward with technology and research, in the early 1800s an Irish doctor who was studding in India discovered that marijuana extracts would help people with severe stomach pain and nausea who were likely suffering from cholera. Throughout the 1800s these extracts were sold by doctors and pharmacies all over Europe and the USA as treatment but there were problems that had been noticed. 

Through further research is was discovered that the source of the problems was THC, a chemical compound within the marijuana plant that has psychoactive properties. Before this discovery, marijuana was considered a miracle plant that as curing people of all sorts of ailments. 

The 20th century

Moving in to the 20th century, this is when things started going downhill for the marijuana industry with the Marijuana tax Act being imposed in 1937 as a way to heavily tax those who sell, are in possession, or use marijuana and ultimately ban the product. Later on in the 1900s there was a big stigma placed around the use of marijuana classifying it as a drug in the same category as that of heroine, LSD, and cocaine, all of which are chemical that can be harmful to the body. 

With every single part of the marijuana plant now being illegal, some people lost their means of natural medication and had to go through a lengthy process and fight in order to get the right to at least have marijuana for medicinal purposes. To this day, some places will still only allow people to buy marijuana from dedicated dispensaries and only if they have a medical marijuana card allowing them to do so. 

2021

2021 has seen the insane growth of the marijuana market practically worldwide. Today, there are states all over the US and countries around the world that have started to legalise the recreational use of marijuana. Now, because we are living in a time where technology is ever evolving and research is more easily done than ever, there are so many new and innovative ways to consume marijuana and so many different accessories available on the market for cannabis lovers to make use of and try out. 

There are many different methods of delivery from oral, to inhalation, to even topical. With all this, there are more and more health benefits being discovered almost daily making marijuana a great alternative to modern medicine and for those who would rather be using something more natural.

NIKE vs MSCHF

Nike has filed a federal trademark infringement lawsuit against MSCHF shoes that released a controversial customized version of its sneakers “Satan Shoes” with rapper Lil Nas X. In the lawsuit filed today, Nike accused MSCHF Product Studio, Inc. of trademark infringement over the designer’s 666 pairs of modified Nike sneakers made in collaboration with the “Old Town Road” singer. All 666 pairs sold out Monday.

Fara Sunderji is a partner at the international law firm Dorsey & Whitney in its New York office. Sunderji has extensive expertise in all stages of trademark, copyright, clearance, prosecution, maintenance, enforcement, and litigation. Of the lawsuit she says, 

“Nike’s swoosh is probably one of the most recognizable non-word trademarks in the world.  You see it and you automatically think of Nike as the source of the good on which it appears.  This is how trademarks are supposed to operate, as a source identified.  Nike’s case here is pretty simple to understand:  MSCHF is selling Nike Air Max 97’s that have been modified in a way in which Nike does not approve.  People see these “Satan Shoes” and think they come from Nike and some people don’t like that.  Nike, therefore, claims that the release of these “Santa Shoes” is harming its valuable brand,” Sunderji says. 

“MSCHF will likely argue that they are protected under a theory called the First Sale Doctrine, which allows third parties to resell trademarked goods that have already entered the marketplace.  But the doctrine is limited to the sale of genuine goods.  The doctrine is based on the premise that consumers are not being deceived because they are receiving what they have bargained for, the trademarked good. Under Second Circuit case law, goods are not genuine if they do not conform to the brand owner’s quality control standards, and it is easy to guess Nike’s take on this issue – Just don’t do it,” Sunderji says. 

According to NBC News, the lawsuit states “We don’t have any further details to share on pending legal matters,” Nike said. “However, we can tell you we do not have a relationship with Lil Nas X or MSCHF.”

Trademark attorney Josh Gerben of Gerben Perrott PLLC stated to CNN Business that “It’s a legal rationale that grants artists who purchase and repurpose individual copyrighted products the ability to express and profit off their own creativity.”. He also pointed out Nike shoe redesigners like MSCHF commonly sell their work on online marketplaces. “You’ve got all kinds of artists that go out there and they take a shoe, and they’ll do a whole bunch of custom art on the shoe and maybe resell it for $1,000-3,000,” Gerben said. “This is something Nike is well aware of and has done absolutely nothing to mess with because there’s a sneaker culture here.”

Lil Nas X isn’t named as a party in the lawsuit. Representatives for the musician did not respond to calls or emails requesting comment.

The backlash from social media is incredible with thousands of people expressing their opinions with the shoes and the representation they bring:

  •  South Dakota Governor Kristi Noem tweeted “Our kids are being told that this kind of product, is not only okay, it’s “exclusive.” But do you know what’s more exclusive? Their God-given eternal soul. We are in a fight for the soul of our nation. We need to fight hard. And we need to fight smart. We have to win.”.
  • NBA star Nick Young tweeted “My kids will never play Old Town Road again… I’m still debating about wearing Nike after this come Nike a drop of blood for real”.
  • On Instagram, celebrity musician Miley Cyrus shares a photo proudly wearing the controversial sneakers, captioning the post “Can you see Satan?”.

The controversial ‘Satan Shoes’ were strategically dropped after the release of Lil Nas X’s music video for “Montero (Call Me By Your Name)”, which has already been viewed more than 54 million times.

Lil Nas X took to Twitter in his true fashion posting “I spent my entire teenage years hating myself because of the shit y’all preached would happen to me because I was gay. So I hope u are mad, stay mad, feel the same anger you teach us to have towards ourselves.”

Tums’ Inappropriate ‘Camping Trip Chili’ Commercial

Antacid brand, Tums, recently released a commercial for Tums Naturals which features two women camping in the woods. As they heat chili over their campfire, one of the women begins to feel some heartburn. Suddenly, a towering, ominous red pepper appears behind her menacingly. The pepper is noticeably phallic, and dominates the small woman. TUMS announces, “When heartburn takes you by surprise, fight back.” The woman shown suddenly dropping her chili and defenselessly being dragged across the forest floor. As she is hauled away, she flashes the pepper her container of TUMS–almost as if she is wielding off an attacker with pepper spray.

The commercial has stirred associations with sexual assault, as the woman is dragged off without consent from the phallic figure. Tums’ commercial is an insensitive and inappropriate representation of such serious matters. To equate having some temporary heartburn to being assaulted is a far cry, and comparing the two lessens the severity of experiencing life-long trauma from sexual misconduct. TUMs ineffable lapse of judgement in creating this disturbing commercial is unprofessional, and promotes rape culture through joking about assault and brushing off the severity of such.

The commercial represents the woman as an unknowing victim, painting her in the horror trope light of the ‘final girl.’ The final girl trope in horror movies represents the heroine left standing at the end of the movie who fights off the offending villain, the most ‘pure’ woman–oftentimes a virgin–whose obedience rewards her with life. This trope is rooted in misogyny, and is an outdated sentiment of the entertainment industry’s emphasis on the male gaze. Just like in horror movies, the woman in this commercial gets to escape–thanks to her handy Tums– but this resolution begs the question: without her Tums, what would have happened to this woman? What is it that the giant pepper is threatening her life with, and why did Tums find it appropriate to relate a life-or-death situation to mere heartburn? Some may say it’s for laughs, but when situations like this actually occur– not with a giant pepper, but instead with an aggressive abuser who aims to hurt women– it’s no laughing matter. Whereas in a fictitious horror movie–or Tums commercial– the final girl gets to escape with her life, women who experience sexual assault are forced to live every day with the real life horror of their trauma.

Mulan Boycott

A new movement is taking over social media as pro-democracy activists try to spread a boycott of the new Disney film Mulan.

Disney’s live-action remake of the 1998 original film hit Disney’s streaming service Disney+ this weekend. On top of the monthly subscription fee, those wanting to see Mulan would have to pay $29.99 to unlock it.

Social media users in Hong Kong, Taiwan and Thailand called for movie fans and Disney lovers to avoid the new film because of comments from Liu Yifei, who plays the titular Mulan.

In Aug. 2019, Liu expressed via Weibo, a Chinese social media site, that she supported Hong Kong police. The comments came amid pro-democracy protests in Hong Kong.

Liu was met with instant backlash, but now that her movie is available to stream, the widespread boycott seems to have intensified.

Joshua Wong, a Hong Kong activist, has been particularly outspoken regarding the situation. He asked everyone who believes in human rights to boycott the film.

He also retweeted multiple tweets from other activists. One of which was from Twitter user Gwyneth Kwai-lam Ho, who linked a story about the boycott from The Guardian.

“Not while the true Mulans are suffering in the darkness of a Chinese jail,” the tweet said.

Mulan currently sits at 78% on Rotten Tomatoes among critics but 55% among audience members. It had a production budget of $200 million.

ARMED WHITE MILITIA VIOLENCE

Leading national racial justice organizational leaders issued a joint statement on armed white militia violence and police camaraderie with militia members following the arrest of a militia member in connection with the killing of two police accountability protesters in Kenosha, Wisconsin.

“Tuesday night, two protesters who were advocating for accountability following the horrific police shooting of Jacob Blake were allegedly shot and killed by a 17-year-old associated with a white militia group. We are outraged by these killings. The ability of a minor to travel from another state at the urging of adult white supremacists organizing on Facebook highlights the corrosive and dangerous convergence of race, police violence, and the presence of these violent groups. That this volatile cocktail was allowed to develop led directly to one of the most violent nights in the city’s history. In light of the fact that the suspect apparently crossed state lines in order to commit this crime, the federal government should launch an investigation to determine whether he was involved in an interstate criminal conspiracy.
“We are equally outraged by videos showing Kenosha Police Department Officers exhibiting camaraderie toward militia members – who were out in violation of the curfew before the shootings — and also seemingly ignoring protesters who tried to identify the shooter in this incident. Police solidarity with white militia members is abhorrent and intolerable – and it represents a highly dangerous threat to the lives and rights of people of color. In addition, the fact that Kenosha Police Chief Daniel Miskinis blamed protestors for the killings is another example of the racially disparate treatment that Americans across the country have been protesting against since May and for decades before. We call on Wisconsin Governor Tony Evers and Attorney General Josh Kaul, to immediately investigate and prosecute these killings, the shooting of Mr. Blake, and the increasingly pervasive issue of armed white militia members confronting and attacking protesters demanding police accountability. They must also demand the immediate removal of Chief Miskinis.

“Finally, turning to Facebook, the prevalence of armed white militia groups organizing on the platform is not new. Facebook must also be held accountable for its inaction while these violent groups have been allowed to grow and organize. Facebook must take immediate steps to ensure that its platform is not used to foment violence and hatred — and to take immediate and comprehensive action to put an end to groups using its services to organize activities that perpetuate racism and cause harm.”

Indiana School Quarantines on First Day

Greenfield Central Junior High School in Indiana opened on Thursday, as one of the first high schools to do so in the country. Within hours, the school had to quarantine when a student tested positive for the COVID-19 virus. It appears that the student was tested days before and went to school without knowing the results.

The emergency “Positive COVID-19 Test Protocol” that went into action following the testing involved isolating the student and a two week quarantine order for those who had come in contact. The schools superintendent, Harold E. Olin, knew the situation was coming but was “shocked it was on Day 1.” Nonetheless, Olin said in a letter that “It was very evident today that nearly all of our families and students were prepared to properly follow the safety protocols we have established”.

This comes amidst a national debate over the re-opening of schools in the fall. While most major school districts have announced a remote start, some in places like Texas and Florida, where the virus is running rampant, plan to open in the fall. Teachers unions have been vehemently opposing an in-person opening, threatening and executing lawsuits and strikes to make their point. They put pressure on Trump’s administration, who is urging for children to get back to school.

Further complicating matters is a study from Northwestern and a Chicago Pediatric Hospital found that children five years and younger carry the virus in high concentrations, although a study on their transmission rate has not been conducted.

On top of all the virus concerns is that of the mental health and success of students who are learning virtually. This spans everything from eye health to sleep patterns to ability to socialize. In addition, it can be harder for many students to pay attention and retain material when studying from home.

Trump Banning Tik Tok

President Trump announced Friday night that he plans to ban the social media sensation TikTok, calling it a “severance” from the Chinese-owned app.

“As far as TikTok is concerned we’re banning them from the United States,” Trump told officials aboard his Air Force One flight in Tampa. “I can do it with an executive order or [emergency economic powers].”

This comes after TikTok has been accused of being a security threat from China, with whom tensions are currently high. ByteDance, the app’s parent company, has been accused of giving American users’ information to the country. Meanwhile, a Tik Tok spokesman assures that they are committed to their users’ privacy, saying that “TikTok US user data is stored in the US, with strict controls on employee access.”

The app could be saved from legal issues if the rumored acquisition by Microsoft comes to fruition. The two companies have had discussion and the deal is allegedly in the works, although Trump has voiced opposition to it.

The creators of Tik Tok have also reacted to the ban, and to the ongoing concern for data privacy on the app. One influencer, 18 year old Josh Richards is leaving the app due to the privacy issues after amassing more than 20 million followers on the app. He announces that he will transfer to rival app Triller instead, whose investors include Lil Wayne, Snoop Dogg, and fellow Tik Tok stars like Griffin Johnson and Noah Beck. Other stars are simply just saying goodbye to the app in recent posts.
